Jolly Consulting identified negligence on the part of multiple providers resulting in the death of a young woman after surgery. We then worked with the client to produce case fact analysis supported by research of multiple acts of negligence during the hospitalization. We also played a key role during the mediation by procuring key witnesses and developing exhibits. In the end, the case was settled for 1.7 million dollars, the cap on medical malpractice awards in Virginia at the time.
In a high-profile personal injury suit, we provided the legal team with a summary of pertinent medical research and a neuroradiologist expert to support evidence of a traumatic brain injury. This injury had not been claimed prior to Jolly Consulting’s involvement. A successful result brought a multi-million dollar settlement.
Jolly Consulting reviewed thousands of documents related to prolonged medical care. We provided the client with a concise, user friendly tool which clearly outlined preexisting conditions, injuries and subsequent treatment. We identified related and unrelated treatment. This tool was used by our client during depositions and was a major source of time savings for the litigation team.
Working under a strict deadline, we identified the relevant records from more than ten thousand pages of medical documents. Using this information, Jolly Consulting created short, one-page reports that contained evidence from the medical records which refuted the main allegation of the plaintiff. As a result, our client was able to adjust the mediation offer.
Working with the defense, Jolly Consulting analyzed more than 13,000 pages of documents before creating a concise report identifying the medical weaknesses in the plaintiff’s case. Our client used our findings to mediate for a substantially lower sum than was planned before our involvement.
